These terms and conditions govern the manner in which www.emaritimetraining.com collects, uses, maintains and discloses information collected from users (each, a “User”) of the https://www.emaritimetraining.com website (“Site”). This privacy policy applies to the Site and all products and services offered by www.emaritimetraining.com, and it’s holding company ECDIS Ltd.

Personal identification information

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, register on the site, place an order, fill out a form, respond to a survey, subscribe to the newsletter and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, name, email address, phone number,

Users may, however, visit our Site anonymously.

We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.

We may use the information Users provide about themselves when placing an order only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service.

The email address Users provide for order processing, will only be used to send them information and updates pertaining to their order. It may also be used to respond to their inquiries, and/or other requests or questions. If User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. If at any time the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email or User may contact us via our Site.

How we protect your information

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.

Sharing your personal information

We do not sell, trade, or rent Users personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above.We may use third party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys. Promotion and use of your company name

From time to time we may write press releases, articles or whitepapers about eMaritime Group, eMaritime Training or any of its subsidiaries. By registering on any of our websites, you are agreeing to allow eMaritime Group to use your company name for promotional purposes. The use of said company name will only be written from a positive angle and no libellous story or information will be shared. If we require a quote or testimonial from you, we may write this ourselves for your convenience, however this will always be sent to yourselves for approval before posting of the marketing material

Third party websites

Users may find advertising or other content on our Site that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Site. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to our Site, is subject to that website’s own terms and policies.

Changes to this privacy policy

www.emaritimetraining.com has the discretion to update this privacy policy at any time. When we do, post a notification on the main page of our Site,. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.

ACAT Content

ECDIS ACAT is not designed to relieve Ship Managers/Operators or owners from their obligations under the STCW code.

Assuming your Flag has adopted the IMO 1.27 Model course, Officers should have already completed an STCW 5 Day Generic Course Prior to this. Depending again on your Flags interpretation of Familiarisation or Type Specific, your crews may have also previously conducted other courses to satisfy ISM. This Competency Assurance Training is designed to:

·         Up to date every year with any changes to the make and model of the ECDIS onboard.

·         Understand the key functions for safe navigation.

·         Prepared for PSC or an independent audit or inspection.

·         Refreshed annually in their knowledge of key menus and operational capability of the ECDIS.

·         Company compliant in ECDIS through annual assessments.

Your Flag may have given guidance on Type Specific Training, or Ship Specific Training as it is referred to by the United Kingdom Maritime Coast Guard Agency.

By accepting these Terms and Conditions the buyer is acknowledging that they are content with  their Member State and ISM requirement.  This product will not be refunded should the buyer subsequently change their decision on what this product equates to.

As an example of member state requirement, elements of the current UK MIN which expires on 9th April 2019 is below.  The below shows the decision on what constitutes ship specific training is placed on the ship owner or operator.  Further guidance is provided.

3. ECDIS Ship Specific Training

3.1 ECDIS ship specific equipment training for Deck Officers must relate to the make and model of the equipment fitted onboard the ship which they are currently serving.

The decision on how to deliver ship specific training is now the responsibility of the ship owner or operator.

They must take into account their responsibilities in accordance with ISM code (specifically sections 6.3 and 6.5) and also the STCW convention, Regulation I/14 – 5:

ISM: 6.3 “The Company should establish procedures to ensure that new personnel and personnel transferred to new assignments related to safety and protection of the environment are given proper familiarization with their duties. Instructions which are essential to be provided prior to sailing should be identified, documented and given.”

ISM 6.5 “The Company should establish and maintain procedures for identifying any training which may be required in support of the safety management system and ensure that such training is provided for all personnel concerned.”

STCW Convention regulation I/14 – 5: Every company shall ensure that: “Seafarers, on being assigned to any of its ships, are familiarized with their duties and with all ship arrangements, installation, equipment, procedures and ship characteristics that are relevant to their routine or emergency duties”.

Refund Policy

This product is non refundable once any registered member within the Hull/Shipping Company/Fleet/Office either completes a course, is issued a certificate, or has access to the modules for over 30 days.

Mutual Agreement & Right to Cancel Accounts

If the company requires their crew to complete the courses via any method other than onboard (ie: via the company offices or building) the company must purchase a custom “Corporate Rate” for the courses. This is due to the fact that the current ACAT system is designed to be run and accessed via a hull-based system, and as such a mutual agreement that we trust you to only register crew members to their respective hulls. We will periodically check all accounts to ensure this agreement has been adhered to, if we find that an unreasonable amount of crew have been registered to any one hull, we are in our rights (after confirming this with you) to close your account without prior warning.

Alternative Company Rates

The alternative to a hull based system would be for the company to give access to crew via their company offices. In this situation we would require you to purchase a bespoke “Corporate Package” based on the fact that more than a reasonable amount of crew would have access to the course(s) via a “hull”. The cost of this package will be unique to each customer based on their own circumstances.

Your acceptance of these terms

By using this Site, you signify your acceptance of this policy and terms of service. If you do not agree to this policy, please do not use our Site. Your continued use of the Site following the posting of changes to this policy will be deemed your acceptance of those changes.
